Erst seit dem Zeitalter der Aufklärung in Europa stellten Humanisten das Recht der Machthaber zum Hinrichten zunehmend in Frage. Seit dem 18. Jahrhundert verzichteten einige Staaten auf die Todesstrafe. Seit den Erfahrungen der Weltkriege, nochmals verstärkt seit 1970 und 1990, haben immer mehr Staaten sie abgeschafft: darunter Deutschland mit paintings. 102 des Grundgesetzes, die Schweiz mit Artikel 10 Absatz 1 der Bundesverfassung und Österreich mit Artikel eighty five des Bundesverfassungsgesetzes. Darauf folgend wird ein etwas dunkleres Kapitel der rechtlichen Geschichte der Todesstrafe aufgeschlagen. Dabei handelt es sich um das challenge der politischen Morde und deren Rechtfertigung. Danach wenden sich die Untersuchungen drei völlig anderen rechtlichen Begründungen zu. Zum einen die Rechtfertigung anhand der Geschichte, zum anderen anhand der Sühne und zum Schluss die Begründung anhand des Naturrechts. Allgemein soll die Frage beantwortet werden, ob es nötig ist, die Todesstrafe zu vollstrecken und ob die rechtlichen Begründungen ausreichend dafür sind, diese paintings der Strafe zu dulden.
